Case Information: Plaintiff was cresting a hill on a main thoroughfare. Defendant made a left turn across the path of plaintiff's vehicle, resulting in a collision. Defendant had policy limits of $100,000 and admitted liability in exchange for a $100,000 cap on damages. The trial proceeded on the issue(s) of proximate cause and/or damages.

Plaintiff alleged that he suffered injuries to his neck, right shoulder, back, both hands, left knee, left leg and teeth, dizziness and perilymphatic fistulae (inner ear fluid leak) as a direct result of the accident.

Defendant contended that plaintiff's inner ear fistulae was related to either an airline flight or scuba diving which took place between the time of the accident and the time of the first complaint of injury.
