Case Information: Plaintiff was a backseat passenger in a taxicab. Defendant was traveling parallel to the taxicab, operating a truck. Defendant lost control of his truck and rear-ended the taxicab.

Plaintiff alleged that defendant was negligent in failing to maintain proper control of his vehicle and that he suffered a T-12 spinous process fracture and a herniated disc in his low back as a direct result of the collision.

Defendant contended that he lost control of his truck due to ice and snow on the road, and that plaintiff was exaggerating the extent of his injuries.
