Case Information: Defendant made a left turn from a center turn lane, struck the oncoming plaintiff and knocked the front wheel of her car up onto the sidewalk. Allstate, the primary carrier, offered it's policy limits of $100,000, but UIM carrier, Kemper, refused to waive subrogation and contested liability and damages at trial. The jury awarded all medicals, all wages, past pain and suffering and future pain and suffering, as well as $50,000 in loss of consortium for the injuries to the plaintiff's jaw and neck. Defendant Kemper's motions for Remittitur and for a new trial are pending.
