Location of Incident:  Route 395/I-95 interchange in Virginia

Case Information: Plaintiff was in a line of traffic at Route 295/I-95 interchange in Virginia.  Three lanes went straight ahead and became 395 and two lanes veered to the right toward the Wilson Bridge.  The Plaintiff was in the left of the two lanes heading toward the Wilson Bridge.  The Defendant struck him on the driver's side of his van.

Plaintiff's independent witness testified that the Defendant came off and exit ramp, cut sharply across four lanes of traffic, lost control and tried to veer back across another lane of traffic when she struck the Plaintiff broadside on the driver's side middle of his van.  Defendant claimed that she was forced to lose control by a phantom vehicle which was never identified.
