Case Information: Plaintiff was walking to his apartment complex when he was stopped by security guards employed by Defendant, the apartment complex where he resided. The security guards requested identification and the plaintiff explained that his I.D. was inside his apartment. He subsequently attempted to walk past the security guards. The guards pushed him up against the fence and began to check his pockets and an altercation ensued. Plaintiff was struck in the abdomen, head and face.

Plaintiff alleged that: (1) he was assaulted and battered by defendant's guards; (2) he was falsely arrested; and (3) he suffered injuries to his face, shoulders and teeth in the assault.

Defendant contended that plaintiff's teeth injuries were preexisting and that plaintiff was exaggerating the extent of his injuries.
