Case Information: Plaintiff was allegedly stopped in a line of vehicles. Traffic was stopped for a deer in the roadway. Defendant rear-ended plaintiff's vehicle and subsequently struck a deer in the roadway.
Plaintiff alleged that defendant was negligent in following too close, in failing to pay proper attention to hazards in the roadway and in failing to maintain proper control of his vehicle. Plaintiff further alleged that he consistently maintained his lane of travel, but even if he did change lanes, a quarter of a mile existed between the end of the right lane and the point of impact.
Defendant contended that plaintiff stopped suddenly after making a sudden and unexpected lane change and that plaintiff's negligence was the sole proximate cause of the accident.
