Case Information: Plaintiff and defendant were traveling in the same direction when defendant rear-ended plaintiff's vehicle. Defendant claimed that her brakes failed. Plaintiff did not seek medical treatment until 10 weeks thereafter and at that time complained of pain radiating in his buttocks. Conservative treatment was unsuccessful and plaintiff was referred for an MRI which disclosed a herniated disc at L4-L5. Plaintiff was employed as a railroad construction worker. He was advised to retrain for sedentary light duty employment. Liability was clear.
