Case Information: Defendant ran a stop sign and broadsided Plaintiff.  Defendant claimed sudden and unexpected brake failure.  Police officer investigated brakes at the scene and determined that the brakes were not working after the accident, however he felt the brake failure was not the cause of the accident, and that the tear in the brake line was caused by the accident itself.  State Farm paid their primary policy limits $50,000 and Plaintiff settled with Geico, the secondary carrier, for an additional $27,500.
